2. ACCESSING THE SITE
2.1 The materials on our site are directed solely at consumers who access our site from the United Kingdom. We do not represent that any product referred to in our site is appropriate for use, or available, in other locations. If you choose to access our site from another location, you are responsible for complying with any relevant laws in that other location.
2.2 We do not guarantee that the site, or any content on it, will always be available, complete, accurate or up to date.
2.3 Access to our site is granted on a temporary basis and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time.

3.4 Our status (and that of any identified contributor) as the authors of material on our site must always be acknowledged.

9.1 The following provisions set out the entire liability of us (including any liability for the acts or omissions of its employees, directors, agents and/or sub-contractors) to you in respect of any breach of this agreement, any claim under an indemnity, any breach of statutory duty, any representation, or tortious act or omission including, but without limitation, negligence arising under or in connection with this agreement.
9.2 Subject to clause 9.4 below, our total liability in aggregate for any and all claims made against us (howsoever arising) in contract, any claim under an indemnity, breach of statutory duty, tort (including but without limitation negligence) misrepresentation or otherwise, arising out of or in connection with this agreement shall be limited to the amount of the sums received by us following the purchase of a training programme, diet plan and/or membership subscription by you.
9.3 We shall not be liable to you for any loss of profit, loss of anticipated profit, loss of business, loss of contract, economic loss, overhead recovery, anticipated savings, loss of data, depletion of goodwill product recall nor for any special, indirect or consequential loss or damage, or otherwise for any costs, expenses or other claims for consequential compensation whatsoever (howsoever arising) which arise out of or in connection with this agreement.
9.4 Nothing in this Agreement shall operate to exclude or limit our liability for death or personal injury caused by our negligence.
9.5 The provisions of this clause 9 shall survive the termination or expiry (for whatever reason) of this agreement.
10. GOVERNING LAW & JURISDICTION
10.1 These website terms and the use of the site is governed by and construed in accordance with the laws of England and Wales and by using the site you hereby agree to submit to the exclusive jurisdiction of the English courts.
11. VARIATIONS
11.1 We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of changes we made, as they are binding on you.

In order to proceed, you must agree with the following rules:
1. INFORMATION ABOUT US AND THE USE OF SKINNY JEANS SCHOOL SITE
1.1 We are Skinny Jeans School Ltd (“SJS”, “Skinny Jeans School”, “Skinny Jeans Graduate School”, Fit and Feelgood,“we” or “us”), a company registered in England and Wales under company number 10945114 and with our registered office at 33 Filkins Lane, Boughton, Chester, CH3 5EJ.
1.2 SJS is an online subscription service that provides its members with online coaching, access to exercise videos, cooking footage, recipes and nutritional, health and fitness information. By registering on a course or as a member or by using Skinny Jeans School service in any way, you accept both the Website Terms of Use and these Terms of Purchase (“Agreement or Terms”), which forms a binding agreement between you and Skinny Jeans School.
1.3. You have read and understood the privacy policy, which is incorporated by reference into this agreement and is available on www.fitandfeelgood.co.uk.
1.4. Prior to using Skinny Jeans School service, it is important for you to know and understand that by visiting the site and/or using the service either as browser or member, you are agreeing to accept certain liability and legal and health disclaimers, which we further explain through this agreement. In other words, your use of Skinny Jeans School device is at your own risk, and we do not assume any liability, or make any warranties of any kind, express or implied with respect to your use of the service.

IF YOU DO NOT ACCEPT AND AGREE TO BE BOUND BY ALL OF THE TERMS OF THIS AGREEMENT, INCLUDING OUR PRIVACY POLICY, LIMITATIONS OF LIABILITY, WARRANTY DISCLAIMERS AND GENERAL HEALTH AND LEGAL DISCLAIMERS, DO NOT USE THE SITE OR THE SKINNY JEANS SCHOOL SERVICE.
2. PHYSICAL ACTIVITY READINESS QUESTIONNAIRE
2.1 You acknowledge and agree that you are responsible for your own health and safety at all times, and that you have been assessed by a medical expert (e.g. your GP/Doctor) who has given you consent to participate in physical activity.
2.2 You acknowledge and agree that you are responsible for continuously updating your medical consent through regular assessment in the form of a fitness appraisal by a medical expert (independent and unrelated to Skinny Jeans School Ltd), in particular when choosing a new workout video or exercise programme to follow.
2.3 You acknowledge and agree that Skinny Jeans School and the instructions provided (via written, audio and/or visual) are for general guidance purposes only and should not replace or supersede the advice given to you by your own medical expert (e.g. your GP/Doctor). Should you choose to ignore medical advice, you do so at your own risk and Skinny Jeans School Ltd (its employees and freelance instructors) shall hold no liability for damage and/or injury caused.
2.4 If you are planning to become much more physically active than you are now, you agree that points 2.4.1 to 2.4.8 are correct. If you disagree with any point, it is insisted that you seek medical consent before participating in any physical activity and you agree to do so before joining, subscribing or participating in any Skinny Jeans School programme.
Please read the following points carefully and answer each one honestly:
2.4.1 You are between the ages of 18-69. If you are over 69 years of age, you must check with your doctor regardless of answering the questions below. If you are under 18 you are not permitted to take part in this programme and Skinny Jeans School holds no liability should you choose to ignore this notice.
2.4.2 Your doctor has never said that you have a heart condition and has never said that you should only do physical activity recommended by a doctor.
2.4.3 You have never felt pain in your chest when you have partaken in physical activity.
2.4.4 In the past month, you have not had chest pain at any time and you have never had chest pain that has been made worse by exercise.
2.4.5 You have not lost your balance because of dizziness and you have never lost consciousness.
2.4.6 You do not have a bone or joint problem that could be made worse by a change in your physical activity.
2.4.7 Your doctor is not currently prescribing drugs including, but not limited to, water pills for your blood pressure or heart condition.
2.4.8 You know of no reason why you should not do physical activity.
2.4.9 You do not suffer with diabetes, IBS, colitis, or Crohn’s disease, as the nutritional element will not be suitable.
2.4.10 You are not pregnant, trying to get pregnant, given birth in the last 6 months or breast feeding as SJS the physical and nutritional elements of ALL SJS courses, programmes and information is not suitable
2.5 As a precaution, regardless of your agreement to points 2.4.1 to 2.4.10, but especially if you disagree, you agree to talk to your doctor by phone or in person BEFORE you start becoming much more physically active. You agree to tell your doctor about this PAR-Q and the points you disagreed with. You may be able to do any activity you want – as long as you start slowly and build up gradually. Or, you may need to restrict your activities to those which are safe for you. You agree to talk with your doctor about the kinds of activities you wish to participate in and follow his/her advice.
3. PROFESSIONAL ADVICE & MEDICAL DISCLAIMER
3.1 You should consult your Doctor or other health care practitioner before starting this or any other exercise or nutrition programme to determine if it is right for your needs. This is particularly true if you (or your family) have a history of high blood pressure or heart disease, or if you have ever experienced chest pain when exercising, have high cholesterol or have a bone or joint problem that could be made worse by a change in physical activity.
3.2 Do not use the Skinny Jeans School service if your doctor or heath care practitioner advises against it. If you are experiencing faintness, dizziness, pain or shortness of breath at any time and especially whilst or after exercising, you should stop immediately and seek urgent medical advice.
3.3 Skinny Jeans School service offers health and fitness information and is designed for informational purposes only. Nothing stated or posted on the Skinny Jeans School site or its services is intended to be, and must not be taken to be, the practice of medical professional or counselling care. For the purpose of this agreement, the practice of medicine and counselling includes, without limitation: psychiatric, psychology, psychotherapy, or providing health or nutritional care, treatment, instructions, diagnosis, prognosis or advice.
3.4 You should not rely on any information on the Skinny Jeans school website or its services as a substitute for, nor does it replace professional medical advice, diagnosis or treatment. If you have concerns or questions about your health you should always consult a physician or other health care provider. Do not ever disregard avoid or delay obtaining medical or health related advice from your GP because of something you may have read on the service. The use of any information provided on the skinny jeans school site is solely at your own risk.
4. DIETARY REQUIREMENTS AND FOOD ALLERGIES
4.1 The nutrition support, plans and recipes within Skinny Jeans School are not formulated to suit any nutrient deficiency, allergies or any other food related health problems or illness that can be made worse depending on food consumed. Please contact us prior to purchasing if you are unsure whether this product is suitable for your dietary needs.
4.2 The nutritional support, plans and recipes within skinny jeans school are not formulated to suit the nutritional needs of pregnant or breastfeeding women. If required, we recommend visiting an accredited practicing dietician to help tailor a programme specific to you and your baby needs. If you are no longer breastfeeding, please seek approval from your GP before commencing a Skinny Jeans School programme and following any of the nutritional support, plans and/or recipes.
4.3 Whilst due care has been taken to label recipes with ingredients that may cause allergic reaction, we take no responsibility for consequence of cooking and eating such foods and any allergic reaction which may occur. Recipes are for information purposes only and you are responsible for the application of common sense in choosing if they are suitable for your dietary needs. If in doubt you should consult your GP or a dietician/nutritional advisor.

7. MEMBERSHIP REGISTRATION
7.1 You can browse the site without registering for membership. To have access to the members site and its contents you will need to sign up as a member on one of the membership programmes. Content is varied for each membership.. We reserve the right to cancel your membership at any time at our absolute discretion.
7.2 To be able to register you must:
7.2.1 be 18 years or over; and
7.2.2 have a valid payment method
7.2.3 be resident within the UK
7.3 By registering you agree to our terms of usage and terms of purchase and have read, understood and agreed to our medical and dietary disclaimers and liability.
7.4 Your username and password is solely for your usage. You may not transfer this information, share or pass these details to anyone else for usage of the site.
7.5 You may register as a member via one of our courses/memberships on our membership site including, but not limited to:
7.5.1 Fit + Feelgood in 21 days (21 day kickstart)
7.5.2 Pilates Basics 1 & 2 and Transition
7.5.3 Ongoing subscription to the Fit + Feelgood Inner Circle or membership
7.6. Payment is required upon registration and is made upfront for the programme or the month of our graduate school membership. Payments are non-refundable as access to material is granted immediately upon transfer of funds. You may cancel at any time.
8. OUR SERVICE
8.1 Skinny Jeans School is an online subscription service that provides its members with online coaching, access to exercise videos, cooking footage and recipes and nutritional, health and fitness information.
8.2 Availability and quality of the videos may vary from computer to computer and may be affected by available bandwidth and speed of internet connection. We give no warranties of the quality of your watching experience. You are responsible for all internet access charges.
8.3 We reserve the right to make changes from time to time and without notice to the way in which we operate our service.
9. BILLING
9.1 Paid membership to Skinny Jeans School is available upfront or via the payment plan that you choose. Refunds are not granted for purchased courses, as material is accessible immediately upon completion of sale. Automatic reoccurring payments will be taken until such time as cancellation is received and you may cancel anytime.
9.2. Cancellations can be made via writing to us as per point 1.1 of this agreement or via your online account profile page.
9.3 Where you sign up to our ongoing membership you also agree to the following:
9.3.1 By successfully entering your card details on this site you agree that we are authorised to automatically charge you the agreed recurrent subscription fee at the current rate. The charge will be made to the payment method you selected in your registration. Payments are non-refundable.
9.3.2 The subscription fee will be paid in advance on the calendar day corresponding to the commencement of your membership.
9.3.3 You may access your account details at any time by logging onto your personal profile page at www.fitandfeelgood.co.uk. You may cancel or change your payment method and plan anytime within this section.
9.3.4 If your payment is by credit or debit card, then if your card reaches its expiry date and you have not amended your payment method, then you authorise us to continue billing that payment method and you remain liable for any sums that we are unable to collect.
9.3.5 All payments are made in GBP (£) and the price is correct at time of purchase.
The material available at www.fitandfeelgood.co.uk is intended for sale in the UK only. However, if you choose to purchase this material you are liable for any financial variations in price due to the exchange rate.
10. CANCELLATION AND REFUND POLICY
10.1 You may cancel at any time via www.fitandfeelgood.co.uk by accessing your account page. Alternatively you can email [email protected] or write to us at our registered address: 33 Filkins Lane, Boughton, Chester, CH3 5EJ.
10.2 All cancellations via email or post will be acknowledged within 48 hours. It is your responsibility to chase any unacknowledged cancellations as we cannot be held responsible for cancellations via email/post that do not reach us.
10.3 Cancellations will stop any future reoccurring payments. Refunds will not be made for previous payments whilst access to material is still live.

12.2 In the unlikely event that the problem cannot be resolved at this time and you wish to raise a complaint in full, full written details must be sent us by post 33 Filkins Lane, Boughton, Chester CH3 5EJ or by e-mail at [email protected] within 28 days of the Programme ending which must also include your details of the complaint including your daytime and evening contact telephone numbers and any suggested resolution.
13. PRIVACY AND DATA PROTECTION

14. MISCELLANEOUS
14.1 Please use the site commenting facilities responsibly, in particular do not post content that includes any offensive, obscene or defamatory acts or statements, illegal activities and/or activities which may cause offence to others on grounds of race, religion, creed or sex.
